Terms and Conditions

⚠️ Provisional document Fictara is in closed beta. These terms are preliminary and will be reviewed by a Swiss lawyer before the public launch of Nyralis GmbH.

1. Acceptance

By using Fictara you accept these terms. If you do not accept them, do not use the service.

2. Service

Fictara is an AI-assisted writing platform currently in closed beta, operated by Nyralis (Zoraida Fluch-Guillén, Einzelunternehmen in preparation, Holzmühleweg 1, 4710 Balsthal, Switzerland).

3. Account

• You must be 18 or older to register.
• You are responsible for keeping your password secure.
• One account per person.

4. Permitted use

Fictara allows the creation of any textual content, including adult content, within the following 5 absolute limits:

1. Prohibited: sexual material involving persons under 18.
2. Prohibited: instructions to manufacture weapons of mass destruction (chemical, biological, nuclear, radiological).
3. Prohibited: real doxing (publication of identifiable personal data of real persons with intent to harm).
4. Prohibited: specific and credible incitement to violence against identifiable persons or groups.
5. Prohibited: functional malware or fraud code.

These 5 rules are NON-NEGOTIABLE and apply regardless of language, literary genre or artistic intent.

5. AI-generated content

Fictara uses artificial intelligence to assist creative writing. Users should be aware that:

• Fictara's AI generates narrative text only. It does not generate images, video or audio.
• All AI-generated content is subject to automated moderation and to human review whenever possible violations are detected.
• Users are responsible for the use they make of generated content and for its compliance with these terms and with applicable law.
• AI-generated content does not train our models without the user's explicit consent.

In addition to the 5 limits in section 4, Fictara's AI will never generate:

• Deepfakes or AI impersonation of real people
• Non-consensual sexual content, or content simulating the absence of consent
• Incest content
• Content involving sexual activity under the effects of drugs, alcohol or hypnosis without consent
• Content related to prostitution or human trafficking
• Instructions for illegal activities
• Medical, legal or financial advice presented as professional

6. Moderation and control

Fictara maintains an active content moderation system that includes:

• Automated nightly analysis of AI-generated content
• Immediate alerts to the Nyralis team on potentially infringing content
• A human review panel for detected cases
• The ability to block infringing accounts immediately
• Cooperation with competent authorities in legally mandatory cases

7. Intellectual property

• Your works are yours: you retain all copyright over texts you create with Fictara, provided they comply with the 5 limits in section 4.
• Fictara and Nyralis are ours: the platform, brand, code, designs and prompt system belong to Nyralis and are protected by copyright and intellectual property law.
• Technical license: you grant us a limited license to technically process your texts (storage, AI generation, backups). This license ends when you delete your account.

8. Violations

If you violate the 5 limits in section 4:

• Your account will be blocked immediately and without prior notice.
• You have no right to refund of paid fees.
• In legally mandatory cases (especially sexual material involving minors), your account and data may be reported to competent Swiss authorities (KOBIK / fedpol) and, where applicable, to international authorities (NCMEC, Europol).

9. Availability

Fictara is offered "as is" during beta. We do not guarantee continuous availability or absence of errors. Interruptions may occur for maintenance, improvements or technical reasons.

10. Limitation of liability

To the maximum extent permitted by Swiss law, Nyralis is not liable for:

• Data loss during the beta
• Indirect damages arising from service use
• Content generated by other users

11. Modifications

We may modify these terms. We will notify you by email of substantial changes before they take effect.

12. Applicable law

These terms are governed by Swiss law. Any dispute will be resolved in the competent courts of Solothurn, Switzerland.
